    Answer: Yes! In accordance with Policy for Organization receiving Foreign Funding -2013, max time of processing is 120 days

    Answer: NITB and EAD are working together with all relevant stakeholders, from Processing side hands on training sessions are complete with NGOs we have already done first session and from availability of link, we will work with NITB and NGOs to upload their data in each session we will pick at least 50 NGOs whose MoUs have been signed or whose applications are still under process within a week’s time all data will be populated and processing will shift from manual to e-portal
  • Does this apply to NGO’s only or also to INGO’s?
    Answer: No! for INGOs the e-portal is with Ministry of Interior
  • Will there be mini sessions or show and tell of the portal on yearly basis open for new NGO's?

  • Does this apply to NGO’s only or also to INGO’s?
    Answer: No! for INGOs the e-portal is with Ministry of Interior

  • Under AML/CFT donor risk assessment is mandatory and for this we have to check NGO status with EAD i.e. MoU and registration. For this purpose a real time updated list is required for compliance

  • If a newly registered NGO is getting foreign funding than EAD will do MOU? Though the new NGO is not fulfilling some of the criteria like 3 years audit report or PCP certification?
    Answer: No! These documents are required where applicable, fresh NGOs can apply and fulfill the requirements at the end of each year, when they are eligible to file tax return and furnish Audited Accounts
  • We are waiting for the response of EAD, we don't know our status yet, please let us know should we upload data on this?
    Answer: Once e-portal is launched each NGO can check their status online. Approved and Under Process Cases are monthly updated and can be viewed even now at www.ead.gov.pk
  • What provisions are given to L&O agencies for this portal?
    Answer: Those are covered in existing Policy as ‘Any organization receiving Foreign Funding’
  • If some NGO is rejected, what would be the further process i.e. appeal/ knowing the drawbacks/shortfalls
    Answer: In existing Policy of 2013, process of Appeal is defined, we will address any issues/concerns in proposed draft revised Policy of 2020. The Policy for Organizations Reciving Foreign Funding 2013 is available on our website www.ead.gov.pk
  • what about registration of NBFCs
    Answer: Financial Credit Companies if those are receiving Foreign Funding from any source are within the ambit of existing Policy
  • How do you determine the time period of signing the MOU with an NGO? Like some NGOS are signed MOU for few months others for years?
    Answer: As per existing Policy MoU can be signed up to 5 years, yet the MoU is usually signed for Project Timelines. 6 Months MoU is probationary period, when NGO is under watch and if any adverse thing appears MoU might be terminated, if not the MoU can be extended for Project timelines.
  • Are all the other registration laws will be in one process (one-window)?
    Answer: Not Yet!
  • NGOs approved by EAD, do they still need to register with provincial charity commission. It is duplication. Should not that be on one portal?
    Answer: At this point of time, Provincial or SECP registration is required for registering with EAD. One Portal can be a possibility in future when all provincial and Federal NGOs e-portals are interconnected via Application Programming Interface (APIs) for better data sharing, mapping options.
  • If an NGO getting foreign funding through INGO in Pakistan, so should that NGO/project required to submit application to EAD or not?
    Answer: Yes! Any organization receiving Foreign Funding needs to have MoU with EAD to receive that Funding
  • Will this e-Portal be beneficial for individual NGOs to monitor status of others e.g, Allocation of funds and current working areas? This might help in strong coordination and elimination of poor allocations?
    Answer: No! they can check their status and see or update their information
  • Is there any minimum amount and duration of foreign funding? As some projects can be for three months?
    Answer: Those Short projects NoC may be applied at inception stage, and concurrences/shall be obtained before Project launch, Yes! For any Foreign Funded Project MoU requirement with EAD applies. So far no minimum amount.
  • My question is simple that what if any organization is receiving foreign funding through Government of Pakistan. Do they need to get registered too?
    Answer: In existing Policy there is no exemption for any organization whether Government owned, created through Government’s seed money, if they are to receive Foreign Funding, MoU requirement with EAD is essential to be eligible to receive any Foreign Contributions.
  • If a donor asks for EAD MOU before acceptance of proposal, what should we do?
    39. Answer: Donor’s commitment is pre-requisite to apply for MoU with EAD, if you are not receiving Foreign Funding you don’t need MoU with EAD. Its comprehension Issue. Donor’s commitment is part of checklist to be able to apply for MoU with us.
  • Any Facilitation Desk has been established in the EAD?
    Answer: Yes! We have already floated proposal, meanwhile we will guide you through process, with NITB Team via webinars.
  • Will there be a list for the agencies working under Interior ministry on how to examine an NGO? Will this check list will be known to NGOs?
    Answer: This question may be sorted by Ministry of Interior EAD provides checklist which is already available at www.ead.gov.pk regarding what documents are required for MoU however if an NGO has signed MoU with EAD that means it has fulfilled and gone through thorough process and we recommend that EAD approved NGOs may be picked for any Foreign Contributions.
  • we have received acknowledgment regarding submission of documents our application still under process and funding has been stopped after exemption period is over, can EAD facilitate us in getting Funds till final out come of our registration?
    Answer: Yes! Kindly send us your concern and we will intimate SBP to facilitate your funds till final out come of your under process application
  • Provincial Charity Acts registration is in places in provinces. How could we leverage EAD MOU with Charity Acts?
    Answer: To work within a Province an NGO has to be registered with that Province, for broader framework they get registered with SECP, however all NGOs are not EAD domain only NGOs/Organizations receiving Foreign Funding falls within our ambit.
  • There are many international treaties and conventions like Framework Convention on Tobacco control, CRC, CEDAW etc signed by the government of Pakistan that calls for effective involvement of NGOs in implementing the projects. So GOP is already committed to involve NGOs in development. Will EAD be identifying NGOs in convention specific areas for donors?
    Answer: EAD updates its approved NGOs List on monthly basis and encourages all Development Partners/Donors to work and engage the NGOs who have signed MoU with EAD.
  • Why NGOs signed their MOUs with EAD need to register themselves again with provincial charity commission?
    Answer: Its other way around to be able to work in province Provincial registrations comes first, its part of our checklist to be able to work in province but once EAD MoU is in place, I don’t think you need any other registration with Province. However provinces will be Partners on EAD e-portal once launched and hence there will be no duplication.
  • Newly registered NGOs have no foreign funding but why banks hesitate to open accounts? is there any restrictions from EAD?
    Answer: Bank Account details are to be provided to EAD before any NGO applies for MoU for signing, Bank Account is preliminary requirement, part of our checklist, If Banks are asking for MoU first they need to understand that EAD requires Bank Details first where NGO intends to receive foreign contribution. It’s only an understanding issue

    Answer: if NGO is regretted, either they can file Review/Appeal to EAD, requesting for opportunity of being heard, the Review Committee communicates the, reasons and investigates evidences, facts and explanations offered by the appellant and decides accordingly, the decision of the Review Committee is however final.

    Answer: EAD believes in continuous improvement, we already engaged all stakeholders along with CSOs in formulation of Draft NGOs Policy 2021 for organizations receiving foreign funding, to create a consensus document in order to address concerns of each stakeholder, which hopefully will be soon launched, several webinars (virtual sessions) and number of in person sessions at Peshawar, Lahore, Karachi, Islamabad, have already been organized with the support of CSOs to create awareness on systems and procedures of EAD, some of organization that hosted the events are CBM, HRDN, CWSA, SPADO, SDPI, PCP, PIDE. We are aware of issues being faced at User End and processing end but we are continuously improving it with technical teams at NITB, and will keep addressing any issues being faced by stakeholders as well as will keep on improving our system according to required adjustments.
  • 57.Will EAD contact organizations whose cases are in process for uploading documents?
    Answer: EAD has already requested all organizations who have signed MoUs with EAD to upload their soft data via NGOs portal for future correspondence and ease of doing business. We are also encouraging uploading your applications online so they can be processed via portal rather manually.

    Answer: So far with limited staff we are trying to make it work but we do have a comprehensive proposal to create help desk as well as analytical team for digital monitoring and facilitation

    Answer: EAD mandate is restricted only to projects where organizations are receiving foreign contributions from development partners, INGOs, individual philanthropists or any International organization with no branch office in Pakistan. However, INGOs is being dealt in by MoI and NGOs is specifically being dealt in by SWD and Charity Commissions

    Answer: EAD only deals with NGOs receiving Foreign Funding, Social Welfare Departments, Charities Commissions, or concerned registration authority may take up this issue with Banks

    Answer: With NGOs portal, all data uploaded can be analyzed, for future EAD plans to have a re-structured NGOs Wing with a Team of help desk facility and Data Scientists for application of algorithms for extracting any data or information required along with digital monitoring through data mapping and data sharing

    Answer: Time of MoU duration is in accordance with Project timelines however as most NGOs/organizations require extra time as project evaluation, impact and other reporting requirements are to be conducted by Donors before clearing all financial liabilities, EAD as per existing policy signs MoU for 2 years, giving extra time to clear all project activities. However, in case of provisional approval, EAD signs MoU for 6 months, and this is considered probationary period when NGO- organization is under watch, if nothing adverse id reported during probationary period the MoU is extended for another 1 year, 6 months, if adverse reports are received, the MoU is terminated immediately.
  • 74.Is there any minimum amount and duration of foreign funding?
    Answer: Most of NGOs/organizations have different duration for different projects, some are short term, some are long term, this depends on Donor’s priorities and between NGO/organization and the Donor, EAD only analyze details of projects submitted
  • 75.What if any organization is receiving foreign funding through government of Pakistan?
    Answer: If organization is receiving Foreign Contribution through Government of Pakistan, that means the funding has been secured by EAD and the executing Ministry, Division, Department has followed the approval process of PSDP or PC1 approvals before its implementation, however if the NGO is receiving that funding for implementation, it has to sign valid MoU (as this is indirect Foreign Contribution) being received by NGOs-Organizations
